Terms of Service and Legal Agreement

Expert Resumes LLC

1. Introduction

This Terms of Service and Legal Agreement (the “Agreement”) governs the relationship between Expert Resumes LLC (“we,” “us,” “our”) and you (“you,” “your,” “Client”) with respect to all services rendered by Expert Resumes LLC, including resume writing, LinkedIn profile recommendations, and career branding assistance.

By purchasing our services and submitting payment, you agree to be legally bound by this Agreement in its entirety.

2. Scope of Services

We will provide you with the services specifically outlined in your order confirmation and/or invoice, which may include:

  • Professionally written resume

  • LinkedIn profile optimization recommendations

  • Career story development

  • Up to two (2) rounds of revisions per resume project

  • General advice for job search positioning

We do not offer executive biographies, board resumes, placement services, professional introductions, or guaranteed interview opportunities.

3. Payment Terms

  • Full payment is due at the time of service initiation.

  • Payment shall be made by credit card, debit card, or other accepted methods.

  • Declined payments, chargebacks, or returned payments will incur a $35 service fee and may result in service suspension.

  • Overdue amounts shall accrue interest at the lesser of 1.5% per month or the maximum rate permitted by applicable law.

  • You agree not to initiate chargebacks; if you do, you agree to reimburse us for all resulting fees, costs, and damages.

4. Refund Policy

  • Refunds are only available within seven (7) calendar days of the initial payment, provided that no draft or service work product has been delivered.

  • After seven (7) days or upon delivery of any drafts, outlines, recommendations, or branding documents, all payments become non-refundable.

  • All services are custom-built based on your information, and the labor invested is non-recoverable.

5. Service Timing and Client Obligations

  • Typical service timelines range from 7 to 14 business days after receiving full client information and payment, depending on client responsiveness.

  • You must provide accurate, complete information and timely feedback.

  • Failure to respond to communications within thirty (30) consecutive calendar days may result in termination of services without refund.

  • We may suspend services permanently if no response is received for ninety (90) days.

6. Limitations of Liability

  • We do not guarantee job placement, interviews, promotions, or career outcomes.

  • Deliverables are provided “AS IS” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or ATS (Applicant Tracking System) compliance unless expressly agreed to in writing.

  • Our maximum liability to you under any cause of action shall not exceed the amount you paid for our services.

7. LinkedIn Services

  • We do not log in to your LinkedIn account.

  • We provide content recommendations only.

  • You are solely responsible for implementing any profile updates on LinkedIn.

8. Ownership of Materials

  • Upon full payment, you are granted a non-exclusive, non-transferable license to use the deliverables for your own personal, non-commercial career purposes.

  • We retain all rights to methodologies, frameworks, and proprietary content created in connection with your services.

9. Confidentiality and Non-Disparagement

  • Both parties agree to maintain strict confidentiality of nonpublic information.

  • You agree not to post, publish, or threaten to publish any negative, defamatory, or disparaging remarks about Expert Resumes LLC or its representatives.

  • Breach of this provision may result in legal action, including injunctive relief and recovery of damages of up to $10,000.

10. Indemnification

You agree to indemnify, defend, and hold harmless Expert Resumes LLC and its owners, employees, agents, successors, and assigns from any claims, liabilities, losses, damages, and costs (including reasonable attorneys’ fees) arising from your breach of this Agreement or misuse of deliverables.

11. Governing Law; Dispute Resolution

  • This Agreement shall be governed by the laws of the State of Florida, without regard to conflicts of law principles.

  • Exclusive jurisdiction and venue for any dispute shall lie with the courts located in Hillsborough County, Florida.

  • Either party may seek injunctive relief for actual or threatened breaches of confidentiality or non-disparagement obligations.

12. Entire Agreement

This document constitutes the entire agreement between you and Expert Resumes LLC regarding the subject matter and supersedes all prior agreements, understandings, or representations.
No amendment, waiver, or modification of any term shall be valid unless in writing and signed by both parties.

13. Acceptance

By submitting payment and/or placing an order, you affirmatively accept and agree to be bound by this Agreement.
